Terms of Use

1. Acceptance of terms


These terms and conditions (the "Terms") govern the use of www.dentalpathways.com.au (the "Site"). By using this Site, you indicate that you have read and understand these Terms and agree to abide by them at all times.


2. Information on website is general information only

The materials and content on the Site (the “Website Content”) are not comprehensive.  The Website Content is designed to provide you with general information regarding the services offered by Dental Pathways Academy Pty Limited (“Dental Pathways”) which is the owner of the Site.  Dental Pathways has not created the Website Content with your specific needs, objectives or circumstances in mind. 


While Dental Pathways has taken reasonable steps to ensure that the Website Content is accurate, current and complete, Dental Pathways does not represent, warrant or guarantee its accuracy, currency or completeness (to the maximum extent permitted by law).


3. Licence to use the Site

Dental Pathways grants you a non-exclusive, royalty-free, revocable, worldwide, non-transferable licence to use the Site in accordance with these Terms.  All other uses of the Site without the prior written consent of Dental Pathways are prohibited.


4. Prohibited use of the Site

You must not do or attempt to do anything that is unlawful, prohibited by any laws applicable to the Site, anything which Dental Pathways would consider inappropriate or which might bring Dental Pathways or the Site into disrepute.

 

This includes:
anything that would be a breach of any other person’s privacy (including if you upload personal information about an individual without their consent) or any other legal rights;

using the Site to defame, harass, threaten, menace or offend any person;
interfering with anyone using the Site;
tampering with or modifying the Site, knowingly transmitting viruses or other disabling features, or damaging or interfering with our website, including  using trojan horses, viruses or piracy or programming routines that may damage or interfere with the Site; and
facilitating or assisting a third party to do any of the above acts.

4. Intellectual property
 
Unless indicated otherwise, Dental Pathways owns or licences all rights, title and interest (including intellectual property rights) in the Website Content and the training materials offered by Dental Pathways (the “Course Content”).  Your use of the Site and your participation in any training courses offered by Dental Pathways does not grant or transfer to you any rights, title or interest in relation to the Website Content or the Course Content.


You must not copy the Website Content or the Course Content (in whole or in part) or sell it to any third party.
You must not breach any intellectual property rights connected with the Website Content or the Course Content, including (without limitation) altering or modifying any of the Site, the Website Content or the Course Content or creating derivative works from the Website Content or the Course Content.


5. Feedback and testimonials

We really appreciate your feedback. If you review us, or provide us with a testimonial, you permit us to post or otherwise transmit the review or testimonial on our social media or other channels. You can ask us not to do this at any time.


6. Third party websites

The Site may contain links to websites operated by third parties. Dental Pathways does not control, endorse or approve, and is not responsible for, the content on those websites.  We recommend that you make your own investigations to ensure those websites are suitable for you.


7. No warranties
 
To the maximum extent permitted by law, Dental Pathways makes no representations or warranties about the Site, the Website Content or the Course Content, including that:


they are complete, accurate, reliable, up-to-date and suitable for any particular purpose;
access will be uninterrupted, error-free or free from viruses; or
the Site will be secure.


You read, use and act on the Site, the Website Content and the Course Content at your own risk.


8. Limitation of liability and indemnity
 
To the maximum extent permitted by law, Dental Pathways is not responsible for any loss, damage or expense, howsoever arising, whether direct or indirect and/or whether present, unascertained, future or contingent (“Liability”) suffered by you or any third party, arising from or in connection with your use of the Site and/or the Website Content and/or the Course Content and/or any inaccessibility of, interruption to or outage of the Site and/or any loss or corruption of data and/or the fact that the Website Content or the Course Content is incorrect, incomplete or out-of-date.
 
To the maximum extent permitted by law, you must indemnify us, and hold us harmless, against any Liability suffered or incurred by us arising from or in connection with your use of the Site or any breach of these Terms or any applicable laws by you. This indemnity is a continuing obligation, independent from the other obligations under these Terms, and continues after these Terms end.  It is not necessary for us to suffer or incur any Liability before enforcing a right of indemnity under these Terms.


9. Jurisdiction
 
Use of the Site and these Terms are governed by the laws of New South Wales, Australia. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in New South Wales and any courts entitled to hear appeals from those courts and waive any right to object to proceedings being brought in those courts.


If you access the Site and you are based overseas, we do not represent that the Site complies with the laws (including intellectual property laws) of the country in which you reside (if you reside outside Australia).  You are responsible for complying with the laws of the jurisdiction where you access our website and please note that you access the Site at your own risk.
